SPECIAL MEETING
ROCHESTER PUBLIC UTILITIES BOARD

A closed meeting with the City of Rochester Common Council to receive a communication and engage in legal strategy discussions with the City Attorney regarding the anticipated filing of a lawsuit against the Southern Minnesota Municipal Power Agency. This closed meeting will occur pursuant to Minnesota Statutes Section 13D.05, subd. 3(b) and is based upon the information contained in the City Attorney's June 24, 2005, memo that is attached hereto.

NOTE: THE CITY COUNCIL UNANIMOUSLY APPROVED TO FILE A FORMAL COMPLAINT AGAINST THE SOUTHERN MINNESOTA MUNICIPAL POWER AGENCY. SEE ATTACHED REQUEST FOR COUNCIL ACTION.
